3) The items which are not covered in above shall be charged as will be decided by Mayor/MIC.

Note :
1.

In case of Charitable Institution, Govt. sponsored Educational Institution, Govt. sponsored health care unit and place of Worship, prayer for rebate upto the limit of 50% of the total permit fees as per Table 3, Table 4, Table 4A, Table 4B & Table 4 may be considered by Mayor/MIC.

2.

The items which are not covered above, shall be charged as will be decided by Mayor/MIC.

3.

In case of development work relating to Charitable Institution, Govt. Sponsored Educational Institution, Govt. Sponsored Health care unit funded entirely by M.P. / M.L.A./S. S. no permit fees & charges will be levied on the basis of valid papers.

4.

In addition to the basic scale of fees of sanction for the respective category of building, WT, ST & WS shall be realized for all categories of the building as per following

Note :
1.

No Drainage Development Fee shall be charged where Building Plan was sanctioned before 09/07/1999.

2.

There shall be no Drainage Development Fee for the cases having Sanction Plan in respect of Regularization of any Building U/s 400 (1) and 416 of the KMC Act., 1980 and dealing under Rule 25(2)(a) and 25(2)(b)/Rule 26 of Building Rules 1990/2009 respectively and Issuance of Occupancy Certificate and doing Renovation work (if no space is generated) if Building Plan was sanctioned before 09/07/1999.

3.

No Drainage Development Fee will be charged in cases of Renovation where no space is generated even if the Sanction is accorded after 09/07/1999.

4.

In case of revalidation of Building Sanction Plan full Drainage Development Fee shall be charged at the current schedule of rate. If paid earlier, said amount will be deducted from current fees. No Drainage Development Fee, however, is to be charged for the plan which expires before completion of five years from the date of sanction due to non-commencement within two years.

Fees for sanction under Rule 25 & Rule 26 for Buildings other than Residential, Govt. sponsored Educational Institutions & Charitable buildings : 2 times of the fees prescribed in Table 7


Note :

For regularization of the constructions in violation of the provision of rule 25(2) (a) & (2) (b), but within the permissible limit, the usual fees for regularization under the rule 25(2)(a) & (2)(b) will be charged. In case of multiple blocks or buildings sanctioned in one plan only the proportionate basic permit fees for that particular affected block shall have to be considered for the calculation under Rule 25(2)(a) & (2)(b). In such cases no other charges viz. WT, WS, ST, DCP & SC will be levied under rule 25(2) of Bldg. Rules, 1990. All the charges are to be calculated for plans sanctioned and dealt under old rule (bldg. Rules, 1990) or previous building rules as applicable. However, the charges shall be calculated on the basis of actual area.

Note :
1. If any applicant completes the structure of a particular floor as per sanctioned plan and applies for deviation under Rule 25/Rule 26 penalty as well as regularization fees will be levied.
2. If any applicant applies for sanction u/R 25 of the Old Rules, and Rule 26 under the New Rules, before commencement notice, no penalty will be charged.
3. No. WT., WS., ST & SC will be levied u/R 25/26(2)(b) if no extra space is generated.


Fees for Retention of unauthorized Structure u/S. 400 (1)

General Guideline

Generally fees for retention of unauthorized structure or deviated structure from the sanctioned plan constructed without prior permission, though within the sanctionable limit shall be calculated on the basis of the following table. However during calculation only the portion on which such unauthorized construction has been done shall be taken into account. For example if there is a deviation of 100 sq. m. charges shall be levied on the basis of 100 sq. m. category and height of the building. Finally if it infringes F. A. R. and other irrelaxable rule of the building the multiplying factor shall be applicable on the basis of the base value in the category. Suppose, construction of 100 sq. m. of unauthorized structure is made, then the charges shall be determined by multiplying the base value with the multiplying factor as per following table for infringement of Rule in consideration of the total building.

Example : Additional constructed area 625 Sq.m. and height of the building 17.5 m.
 
Violations :
1.  FAR exceeds the permissible limit by 150 sq. m. (Of the total value of existing + regularized unauthorized construction).
2.  Mandatory open spaces affected by 50 Sq.m. (Individually or simultaneously with FAR and Means of Access)
 
Chargeable Fees will be :
1.  Permissible FAR (625-150) = 475 Sq.m. X 1500/- = Rs. 7,12,500/-
2.  FAR violated = 150 Sq.m. X 1500/- X 3 = Rs. 6,75,000/-
3.  Open Space Violation = 50 Sq.m. X 1500/- X 3 = Rs. 2,25,000/-
     Total = Rs. 16,12,500/-

In case of non-residential building the charges shall be levied two times of fees as per in Table 8 along with 'Surcharge' as applicable in Table 6 of the schedule.

 

Charges for reconstruction of roof constructed without prior permission under the appropriate rule of the new building rules, 2009 shall be Rs. 150/- per Sq.m. of the total covered area upto 100 sqm., 300/- per Sqm. upto 200 sqm. of covered area and Rs. 400/- per Sqm. for above 200 Sqm. of covered area. WT, WS & ST will be levied as usual.

 
Note :
1.

The shortfall in car parking space, if allowed under section 400(1) read with section 416, the charge shall be Rs. 1.0 Lakh for shortfall of each car parking space for buildings having height within 12.5 m. & land area within 300 Sqm. Rs. 1.5 Lakh for shortfall of each car parking space for buildings having height within 12.5 m. & land area above 300 sqm within 500 Sqm . Rs. 2.0 Lakh for shortfall of each car parking space for buildings having land area above 500 Sqm

2.

For Conversion of car parking spacein Building sanctioned u/r 142 of bldg Rules2009 of KMC Act ,1980:
a)Rs. 5000 per of Conversion Area where land area is within 300 sqm.
a)Rs. 7500 per of Conversion Area where land area is above 300 sqm..

3.

For partial construction of columns, beams, slabs, stairs etc. 75% of the charges prescribed in Table 9 for residential and commercial use shall be levied.

4.

In addition to this the sketch fees shall be levied as per Table 9A

Fees for change of Technical Person under Rule 44
For change of LBS/Architect/ESE/MIE under Rule 44 may be made & an amount of Rs. 10,000/- for each such change will be charged.

 

For extension of time period for completion of work in accordance with the sanctioned plan as per provision of Sec. 399 of KMC Act.

 
I)

For extension of validity of plans (if permitted), the permit fees as per current rates for the respective category of Building shall be charged according to the width of the road (as per Table 2 & Table 3).

II)

In case of incomplete building the balance portion that remains to be constructed will be taken into consideration for payment of charges.

III)

Where the construction could not be commenced within the stipulated period of time, the fee shall be charged for the whole building as per current rates (Table 2 & Table 3) excluding all other fees & charges as per prevailing rate restricting the validity period upto five years from the original date of sanction. But further 5 years extension of the validity can be granted from the date of such extension if total permit fees is provided as per prevailing schedule.

IV) For cases where :
  (a)

Construction upto plinth level is completed :- 90% of the total permit fees for the portion to be revalidated will be levied.

  (b)

Structural works like columns, beams, slabs in framed structure building or in any masonry building slab, beams, brick column, load bearing wall etc. are completed.

    (i)

60% of total permit fees will be charged when no floor/roof slab has been cast.

    (ii)

60% of total permit fees will be charged when no floor/roof slab has been cast.

  (c)

Partition wall, doors and windows, stair, lift machine room & other necessary finishing works are not completed : - 20% of the total permit fees will be levied upto 300 Sq.m. of floor area and 40% for more than 300 Sq.m. of floor area.

  (d)

For plastering, colour washing, white washing, painting or any decorative works no further fees shall have to be paid by the applicant. Only a Notice shall have to be given to KMC before commencement of such work.

V)

If extension of time period is allowed to a sanctioned plan and if it is found that the total covered area of the said plan is more than that permissible under prevailing bldg. rule the permit fees including all other relevant charges for the excess covered area will be charged at 2 times of the present fees.


Fees And Charges For Change Of Use Under Sec 416


A. For Issuing Sanction
In case of Residential to Non-residential only Permit fees (without Wet Work Charge, Waste Water charge, Stacking fee and Infrastructure Development fee for common passage), for the respective category of Building to which the conversion proposed, according to the width of road shall be charged. In addition to this a Surcharge including Development fees as per Town & Country Planning Act shall be charged.

Note :
1.

Change of use if permitted, from one category to other category within the same use group 25% of the usual permit fees excluding WT, WS, ST & SC (Provided existing use is already sanctioned or it was existing before 01.4.84) is to be paid.

2.

-do- -do- not being within the same use group, (other than residential) 100% of usual permit fees excluding - do- -do-

3.

-do- -do- from non residential to residential, 25% of usual permit fees as per category being applied for excluding -do- -do-

4.

Above rates are applicable in cases applications are made within the validity period of the present sanction plan and before obtaining completion certificate. If any application is made after obtaining completion certificate or after expiry of validity of sanction, full permit fees including SC but excluding WT, WS, ST will be charged.

5.

A fine of Rs. 100/- per Sqm. per month considering floor area is to be levied for minimum one month only in case of change of use from non-residential to residential already caused contravening any provision of relevant section, if such area is permitted by the authority. This fine in other cases, however, will be for minimum six months in addition to two times the other fees & charges as per Table 11 when sanctioned by the authority in relaxation of Rule 61 & Rule 51 of Building Rule 1990 or Rule 59 & Rule 69 of Building Rule 2009.

6.

Under special circumstances, if change of use is granted after use as fait accompli, one and half times of the fees of respective scale for respective use group as per Item 1 of Table 11, will be charged.

7.

When covered area is within 50 Sqm., fees for violation of means of access & FAR will be twice the basic permit fees. Payable amount is to be calculated as per the guidelines given below.


Guidelines for calculation of permit fees for change of use :
Permit fees u/S 416 in the existing building where sanctioned plan is submitted the rates will be charged considering whole building on pro-rata basis & considering basic rates and multiplying factor with Surcharge & Infrastructural Development fees but without WT, WS & ST. No SC will be charged in cases of conversion from Non-residential to other use group. When pro-rata calculations is not possible due to want of sanctioned plan the usual charges will be multiplied by five times to arrive at leviable charges.

 

Fees for change of Technical Person

Change of LBS/Architect/ESE/Geo-Tech Engineer may be made & an Amount of Rs.10000/- for each such changes will be charged.

In Case department take any disciplinary action for professional misconduct against LBS/Architect/ESE/Geo-Tech Engineer or in case of death of any professional,no fee will be charged for such change.

Note :
1.Rate Shall be determined by considering total Sanctioned Area of a Use Group.CC/Partial CC Fees payable will be sum of (Use Group wise Area for which CC/PCC is being Granted multiplied by Corresponding Rate)

2. Additional fees payable for partial CC cases : In addition to the normal fees as per the above table for the area for which PCC is being granted, the following fee will be applicable.

If land Area upto 300 Sq.M. and primary Use Group is Residential / educational/ Institutional , additional fee of Rs. 2000/- applicable.
If land Area above 300 Sq.M. and upto 500 Sq.M. and primary Use Group is Residential / educational/ Institutional , additional fee of Rs. 5000/- applicable.
If land Area above 500 Sq.M. or primary Use Group is Commercial in nature , additional fee of Rs.10000/- applicable.

3. In case of Building funded entirely by M. P./M. L. A./S. S. fees for C. C. will not be levied.
4. "Fait accompli" Completion Certificate - 4 times of the prescribed fees as stated above will be levied.

Fees for installation of Lift in existing building u/S 410
1. In case of residential building fees : Rs. 5000/- per sq. m. of ground covered area of the lift
2. In case of Office/Commercial/Factory etc. : Rs. 12000/- per sq. m. of ground covered area of the lift

Permit fees for Roof Garden if sanctioned as per norm
Roof Garden with restaurant or commercial use will be charged for effective covered area on roof as per Table 1 & Table 2 considering commercial rates including all the charges.

Fees for revised sanction
If any revised plan is submitted in modification to a sanctioned building plan within its validity period then the higher of the following amounts will have to be paid by the applicant for revised sanction :-

1. The amount of sanction fees including all other charges as per present submitted plan on the basis of present rate in excess of the amount paid during initial sanction.
2. 25% of the sanction fees as per present rate including all other charges as would be applicable from time to time.
3. If it is found that more than such payable amount is already paid during initial sanction no refund will be made. However at least 25% of the present sanction fees including all other charges shall have to be paid for obtaining revised sanction. Other fees as applicable will also be levied.

Mechanical parking Installation fees
1. If within required parking :No Charges. 2. If excess over required parking : rs. 50,000/- per car parking.

Fees for Swimming Pool
1.Total fees as will be applicable for the covered area of the galleries considering respective scale of fees and charges has to be levied. 50% of the covered area of the galleries will be taken into consideration for all practical purpose.

2.In addition to above, 10% of the total area of the water body will be taken into consideration as covered area for application of fees and charges for all practical purposes. Area of the bank will not be considered for any fees.
